I should say to you up-front that I can appreciate your style to which I referred as being similar to high-schoolers at a snack shop after a football game, may have played an important part in gaining listenership and helping you achieve superstar status for radio talk show hosts. Guy - Glenn Beck is just not some obscure radio host on Err America. The numbers in his audience I think come in 2nd under Rush. Whether he realizes it or not, his overall theme promotes conservatism. And this is good. Conservative ideals are pretty much laid out in the Declaration of Independence. However, as you know, I do have some problems with him as you do as we've already discussed.
Other than at times Glenn sounding like the loudest member of one of those attention-seeking, cute by half, high-schooler coteries occupying booths at the Snack Shop after a football or basketball game, here below is copy of a radio transcript of his show of another thing about him which really irks me considerably more.
He'll, without essentially coming out and saying it, all but tell his listeners to:
- ignore one rather simple, three-word term in the Constitution, "natural born Citizen," and [other than during the lifetimes of those living at the time the Constitution was ratified] the fact that it is an absolute, Constitutional requisite of a person's status prior to that person holding office as President and thereby having any Constitutional power whatsoever to execute any duty of that office, an office which, of course, was created by that very Constitution,
- in favor of having them argue unconstitutionality of Congress being empowered to regulate and/or create medical insurance [which he simply calls "healthcare"] in the private sector even though it, Congress, has already been involving itself in it in varying degrees for quite some time as well as being, along with the president, in command and control of the VA and its healthcare.
Gosh, Beck seems to think that millions of Americans can't do effectively more than one thing at a time; much less three, like drive, chew gum, and listen to the radio.
Assuming erroneously that all his millions of listeners and TV viewers in toto can effectively only address but one grievance, Beck thinks apparently that it would be simpler, "actionable," and "provable and true," and enormously faster for his listeners to tackle the problem of, no doubt, having to show that "healthcare" is not in any way covered under the meaning of "general Welfare" in Article. I. Section. 8. Clause 1, of the Constitution.
In so doing, his viewers and listeners, "the average Joe" as he calls them collectively, would have to convince a court of competent jurisdiction, which might be some form of majority of the members of Congress in their official capacities, that the thing created in the Constitution it calls Congress, pursuant to Article. I. Section. 8. Clause 1:
- is ONLY empowered by this Clause to "provide for the common Defence and general Welfare" of each and every artificial entity identified expressly as a "State" of the "United States" [another artificial, that is to say "manmade," thing]; as opposed to the thing called Congress; and
- is NOT empowered Constitutionally [needless to say in that nothing else can empower this artificial creation] by this same Clause to "provide" anything and everything and including power to sidestep or ignore the jurisdictions of each of the several States and single-out and distinguish individual persons or groups of people in their individual, private, personal capacities irrespective of their State citizenship whereby Congress could "provide" each and everyone of them healthcare and insurance for that care.
Yep, it should be a "cake walk," don't you think? They'd just have to convince said court that the legal maxim "expressio unius est exclusio alterius" applies to our Constitution as well as our various States' statutes.
"When certain things are enumerated in a statute, that enumeration implies the exclusion of all other things even if there are no negative words of prohibition." See People ex rel. Daley v. Grady, 192 Ill. App. 3d 330, 333, 548 N.E.2d 764, 766 (1989) (applying the statutory rule of construction of expressio unius est exclusio alterius ("the expression of one thing is the exclusion of another") (Black’s Law Dictionary 521 (5th ed. 1979).
And oh yes, the "average Joe," while showing a court of competent jurisdiction that Congress is not empowered Constitutionally to control, or spend money on, our nation's "healthcare" and/or "healthcare insurance" he will also be inasmuch showing in that same argument that Congress is not empowered Constitutionally to control, or spend money on, many other so-called entitlement programs such as, but not limited to Medicare, Medicaid, Food Stamps, Public Schools, and Social Security that all seem to rely speciously on that same "general Welfare" clause. Guy, you think the "average Joe" will run into much resistance?
Don't get me wrong, though. I think it is a worthy endeavor. However, I see it as an endeavor that could easily take a lifetime to accomplish. And, once accomplished, many more lifetimes to keep it that way.
Glenn Beck suggests differently. He seems to think that doing this would be much more speedy than his guess of it taking about 5 years for Congress or some [other] court of competent jurisdiction to convince the State of Hawaii that it has "a direct and tangible interest in the record" pursuant to and quoting, in part HI §338-18 Disclosure of records [ http://www.capitol.hawaii.gov/hrscurrent/Vol06_Ch0321-0344/HRS0338/HRS_0338-0018.htm ] to be provided a certified copy of the original, long-form birth certificate for determining Constitutional qualifications for one to sit in the office of President or just to provide evidence of criminal fraud.
This long-form, original birth certificate should not be confused with a birth certificate pursuant to HI §338-17.8 Certificates for children born out of State [ http://www.capitol.hawaii.gov/hrscurrent/vol06_ch0321-0344/HRS0338/HRS_0338-0017_0008.HTM ] where this document is available to parents of a child "while living without the Territory or State of Hawaii [who] had declared the Territory or State of Hawaii as their legal residence for at least one year immediately preceding the birth or adoption of such child" [quoting HI §338-17.8].
The term "natural born Citizen" to my knowledge has never been defined in our courts. So, even though someday it may come to pass that Barack Obama's original long-form birth certificate is made public and that such certificate may possibly show that he was born in a foreign country, that in itself will not automatically prove that he is not a "natural born Citizen." We have State courts and State legislatures that try to have people believing that there is no discernible difference between a man and a woman and therefore a man and another man or woman and another woman can marry each other. So who knows, maybe next they'll be saying that there is no discernible difference between "natural" and "naturalized" and that those terms mean basically the same thing when it comes to Constitutional qualifications to be president! Whatever they might decide, we've waited long enough. There is no time better than present to begin to find out. The longer we wait, the worse things can become.
But I digressed [again]. Let me get back to healthcare and Welfare. If the aforementioned competent court challenged Beck's listeners and viewers by suggesting that indeed the "general Welfare" clause was all-encompassing, such would then beg the question, "why did the framers of our Constitution even bother with what would be redundancy by enumerating any other power in the Constitution in that anything and everything that Congress would ever do could be considered Constitutionally authorized under its "general Welfare" clause?
Of course there are a few of us who know that words actually mean something. Noah Webster was one of these people.
Appearing below is a jpg copy of the definition of "welfare" from a dictionary printed about 40 years after the Constitution went into effect back in 1789 (1828 edition of Noah Webster's American Dictionary of the English Language). Note definition "2." where it defines "WEL'FARE" [well and fare, a good going]: "Exemption from any unusual evil or calamity ; the enjoyment of peace and prosperity, or the ordinary blessings of society and civil government ; applied to states." [Emphasis added.]
From what I know, there is no qualified immunity [from civil or criminal liability] for any State or Federal elected officials [office holders] with respect to criminal fraud in State or Federal courts, at least alleged fraud committed in individual, private, personal capacity; which, of course must be the case with respect to an act of fraud perpetrated in an attempt to show one is qualified to hold a particular office. Artificial things, such as offices, can't run for office, only real people can. Only real people can willfully commit acts, lawful or otherwise. Moreover, fraud is an act of a person not a duty of any office holder for which there could be qualified immunity for such performance.
I think it doubtful that anyone who is seemingly holding office as the current President, regardless of whether or not such person was a sitting Senator at the time the alleged fraud took place, could win an argument that he/she had qualified immunity from prosecution when they filed the necessary paperwork to run for a given office because such paperwork was filed by them as a person in their private, personal capacity. Much like such person would not be immune from divorce proceedings regardless of whatever office they may hold or held at the time they were first married or during the time of the commencement of the proceedings No office, that is to say, no artificial thing, in the United States has the prescribed power to marry and enter into such contract. Marriage is an act of real people in their personal capacities and not of artificial things.
Nowadays, exhausting all other possibilities and proving something particular generally takes a lot of time. Proving unconstitutionality is no different. This would be true whether trying to prove that a proposed bill was unconstitutional or that a given elected office had remained vacant during the time which a person pretending to hold that office had done so by unconstitutional means.
Comparing the two, however, the latter should be technically easier. Courts have had a long history of not hearing cases that were hypothetical. A proposed bill unless and until it is enacted into law, remains in the hypothetical and not ripe for adjudication. Ideas and notions cannot be unconstitutional until acted upon.
Our Founders set up a very slow, deliberate government.
The "President," "Congress," and the "supreme Court" among other things are all creatures of The United States Constitution. The powers of these things are purely Constitutional. None of these artificial things existed prior to their creation and ratification of the Constitution in 1789. All powers of these artificial entities are prescribed in the Constitution. None of the powers of these things can be either expanded or limited nor can there be new powers created for them nor can any of the qualifications to hold elected office or positions of appointment be changed in any way for these things solely by any of those holding elected office or positions of appointment. Any such change must be accomplished by way of Constitutional amendment. The Constitution prescribed no exceptions.
What Beck might not realize is that if it were determined by a court of competent jurisdiction, that the actual time and place of Barack Obama's birth cannot be considered as a time and place that would make him a "natural born Citizen .. of the United States," it would be legally impossible, that is to say, Constitutionally impossible, for him to have ever been president. This includes all the time leading up to such determination. There is no "statute of limitations" on the making of such determination.
His so-called presidency would be a nullity; that is to say, not voidable, but simply void.
Lord Monckton had this a little bit wrong. Nothing requiring the signature of the President of the United States would be signed into effect ever since January 20th, 2009, which among many things, would not only include any potentially forthcoming global warming treaty but any national healthcare insurance bill as well. Neither Congress nor some new president may have the Constitutional authority nor any precedent upon which to rely to then retroactively effect legislation, treaties, executive orders, executive appointments [such as czars], presidential nominees [supreme Court justices], etc. and authorize tax dollars already spent on that which was Constitutionally unauthorized.
All persons thought erroneously to be holding positions of executive appointment or nomination by way of the presidency subsequent January 20, 2009, would be holding no such position. Among many others, this would include justices and judges. None of these persons who were thought mistakenly to have held these judicial positions would have any "control in the court system" as Beck had suggested.
In other words, just as his presidency would be a nullity, so too would be anything and everything thought to be effectuated, or committing the American people, with the signature of the President. It would of course be the biggest shake-up of any existing government in world history other than those destroyed by war. Recovery would expectedly take several years, at least for that which would be capable of it. It is my guess that many things would not "recover." Unlike before, all things thought to be federal would be scrutinized with a Constitutional magnifying glass. I would predict a new public awareness of what was Constitutional and what was not.
More and more people and some who we call "experts" agree that the USA cannot continue on the course it seems to be heading. Not long ago we had the "tech bubble" burst, then the "housing bubble." A determination that we had someone pretending to hold the position of President I think would be the "pin" that burst the ever-growing giant "government bubble" that has been slowly choking-off the freedom and liberty of the American people as well as unconstitutionally spending their tax dollars which in turn is putting them deeper and deeper into debt.
If in fact Barack Obama is not a "natural born Citizen" pursuant to the Constitution and such is determined by a court of competent jurisdiction, the ensuing crises created by the void in the presidency might very well be what this country needs, regardless of how devastating, to get those who hold elected office to realize their official limitations and more appreciate that our government is limited. We are a nation governed by laws and not ruled by people. Let's be sure those in office never forget that fact.

GLENN: So there are apparently, apparently there is and I'm just going to there's always games being played behind the scenes at a talk radio show and on television and everything else. It is really, it's very, I don't know, it's disappointing. Rush has called them on the games in radio behind the scenes, Rush has always called them seminar callers. But instead of being coy with the seminar callers or with you, I'm just going to expose the game that is going on. Today there is a concerted effort on all radio stations to get Birthers on the air. I have to tell you, are you working for the Barack Obama administration? I mean, that's the dumbest thing I've ever heard. First of all let me just let's just play these out. If you are a Birther, you believe that the president of the United States was born in, they think Kenya, right? So he was
STU: Anywhere outside of here, I guess, but yeah.
GLENN: Anywhere outside of the U.S. So he was born in Kenya.
PAT: I think it was Managua, Nicaragua.
GLENN: So you believe that he was born outside of the United States of America. And then somehow or another he became and I saw this movie with Frank Sinatra oh, yeah, it's called the Manchurian Candidate. So somehow or another maybe he was indoctrinated or whatever and then he came over here and he ran and became president.
STU: Well, he also, you've got to remember that he preemptively planted his birth announcements in the Hawaii newspapers back when he was actually born.
PAT: Knowing, I mean, his parents knew at the time that someday this man would become president of the United States.
GLENN: That's what they want you to think.
PAT: Right.
GLENN: So he preemptively put those birth announcements there.
PAT: Then hypnotized somehow Hillary Clinton to not find out any of this.
GLENN: Well, not only hypnotized but also
PAT: She's pretty
GLENN: I believe is somehow or another in league with the people that have you know, did you see men in black?
PAT: Yes.
GLENN: Did you see the little flasher thing? Got all of the investigators, and anyone will tell you when the Clintons run for office, you can't get a PI in New York. Can't get one.
STU: You can't, no, no way.
GLENN: Seriously because they're using all of them.
STU: Right.
GLENN: The Clintons can. You can't.
STU: Right.
GLENN: Because they use all of them. Somehow or another the Clinton machine couldn't get their hands on this Birther thing or they did and then for some reason didn't want to release it.
STU: You know why? Maybe Hillary didn't want to be president. Maybe she wanted to be Secretary of State really bad.
GLENN: Yes.
STU: If the Clintons were known for ambition, maybe you'd have something there.
GLENN: If the Clintons, if the charges were from the right that the Clintons kill people for the presidency.
PAT: Right.
GLENN: I have a hard time getting my arms around how they're not
PAT: She's secretly more powerful in the position she's in now.
STU: That must be it.
PAT: If she's so low profile, highly unlikely
GLENN: It is the case that global warming, the world is so hot that it's now cold. You are right. Thank you for that, Pat.
PAT: She is so low profile, she is high profile.
GLENN: So you have that on one side. The other side is he didn't pre emptively plant a story as a newborn. That maybe he was born in the United States of America.
STU: And just to clarify, that would be two separate stories in two separate newspapers that he planted as an infant. It's ridiculous to plant one.
PAT: If you are going to do it, do it right. When babies do things, they do it extremely well.
GLENN: Extremely well, okay. Well, it could have been his KGB control.
PAT: Yes. He has controllers who
GLENN: Yes. Don't know, don't know.
PAT: Have taken control of him from birth.
GLENN: Don't know when the Soviet Union started to recruit.
STU: Right. But some
GLENN: Could be at birth in Kenya.
STU: It could be. That's how you start.
PAT: If you are going for a future president of the United States, naturally you go to Kenya.
GLENN: Of course you do. Of course you do.
PAT: You find a Kenyan.
STU: Especially in the Sixties. You are thinking African Americans.
PAT: In the Sixties.
STU: You are thinking this is the guy.
GLENN: Yes, you are. Well, they've got a roadmap.
STU: They thought all of these complaints and have already defeated them.
PAT: Don't call it KGB for nothing, they are cagey... B.
GLENN: The other idea is that he was born here in America.
STU: Oh, come on.
GLENN: Wait, wait.
STU: Who would think that?
GLENN: Hold on. I know it's way out on a limb here. But as the guy who the media says is the king of conspiracy theories, all I do are forward conspiracy theories, let me forward this conspiracy. He was born here because it seems a little unlikely that somebody planted the birth records, okay, a little unlikely, in the newspapers. Now you would say, well, then why doesn't he just produce? Good question. That one kept me up for minutes at a time, minutes.
PAT: That long?
GLENN: Yes.
PAT: So you tossed and turned for literally minutes?
STU: Not whole minutes.
GLENN: Not whole minutes. Parts of minutes.
PAT: Parts of minutes on different nights?
GLENN: May I go out onto this conspiratorial limb, please. If I'm Barack Obama which I want you to know I'm not, but if I yes, you haven't seen us at parties together, I know. But let's say I were Barack Obama and I had somebody who was forwarding a conspiracy like this.
PAT: And looking stupid doing it?
GLENN: Yeah. And then my advisors would come in and go, let's just make this go away. Here's an idea: Just call the doctor, just get the nurse. Just, here, let's just have, you know, three really credible people examine the birth certificate because really let's just make this go away so we can get on the work with the American people. If I were Barack Obama, I would say, no, now, wait a minute; why do that when these people are so discrediting themselves because if I can get them to discredit themselves and they'll use the argument, "Well, you think it's nonsense to have him answer that question when it's in the Constitution? He would be the first unconstitutional president!" Yes. But I believe he already is, seeing that healthcare is against the Constitution. The fundamental transformation of the country is a little unconstitutional.
STU: Right. When you've lost 40 points off your approval rating, the only thing you have left is the people who are coming out and yelling about your birth certificate. The only positive this guy has left.
GLENN: Yeah. So why would you discredit yourself? Why would let's say it's true. Let's just say it's true that he's not. Do you really think that is the fastest way to get him out? Do you really think that's the fastest way to stop him from what I believe is the fundamental transformation of this country? Do you think that's going to stop healthcare?
STU: No.
GLENN: If you could, if, if you could hold his feet to the fire and say, "Produce the doctors and the nurses and the birth certificate" and somehow or another he couldn't do it, how long would it take you to get to that point? And in that point, in that time how much of the fundamental trans do you still have control of the court system in that time?
PAT: You should be able to get that to the Supreme Court by about 2015 1/2. I'd say by late October 2015.
GLENN: Really?
PAT: You get that right to the Supreme Court, yeah.
STU: There's a helpful conversion chart for Birthers which is Birthers are to Barack Obama as Megan Fox is to every 14 year old boy. A lovely, beautiful dream come true.
GLENN: Dream come true. Dream come true.
STU: There is nothing he could possibly want more than Birthers talking about birthing.
PAT: And look how often the MSNBCs of the world bring it up.
GLENN: Oh, yeah.
PAT: Even if the story has nothing to do with Birthers, they bring them into the story just to throw in another discredited movement.
STU: That's what they do with healthcare. They find the one Birther sign at a healthcare rally and make the healthcare rally about the Birthers. That's what they do. They're using you.
PAT: They love it. They love it.
GLENN: It is the same as, it's the same as carrying signs that show Hitler on it. Nobody is saying that Barack Obama is Hitler. Nobody is saying that. What they are saying is that the Nazi regime started in very much the same way. I mean, it started with an economic trouble, it started with a guy who said one thing but meant, well, meant what he said, actually meant something. You go back and you read Mein Kampf. He laid it all out. But the people wouldn't believe it.
STU: Right. And that does not mean that Barack Obama's going to start the Holocaust.
GLENN: He is not going to start the Holocaust and he's not going to turn us into a Nazi regime.
STU: Right. But the bottom line is believing people who are what they say. He promised changing the economy. He promised energy prices skyrocketing because of his policy.
GLENN: Correct.
STU: He promised a lot of things leading up to this. We should probably listen to them.
GLENN: Now, is it going to be Nazi like? No. Because the Nazis are Nazis. Is it going to be Mao like? Well, there's one that they really do like. They think power comes from the power, the end of the gun. That's according to Ron Bloom. Anita Dunn believes that. Is it going to be Marxist like? Is it going to be like reverend Jeremiah Wright believes America should be? I don't know what it's going to be. I just think we need to start listening to the man. But every time you put a Nazi sign up, that is yet Megan Fox coming in and making out with, who? Give me another hot chick?
STU: Ooh, let's go. This is a better show than what I thought it was going to be.
GLENN: That's what it is. That's what it is. It's Barack Obama looks at the Birthers as Megan Fox and the Nazi signs as

GLENN: Carrie Underwood. And he's like, look and make out; that is fantastic.
STU: And it's really hard to think about healthcare right now.
GLENN: Really hard.
STU: Really hard.
GLENN: Why don't we concentrate on healthcare? Because once healthcare passes, I told you before, it doesn't matter. As they have demonstrated, it doesn't matter what's in the bill! They take it in, put it in, take it out. Doesn't matter. It doesn't matter who's for it, who's against it. They will bribe their way to it. Why? Why? Do you have the audio of one of the senators explaining why that it's the starter house. Do you remember, was it you, Pat? You and I were listening to that?
PAT: We were. We were listening to that.
GLENN: Who was it that said that?
PAT: Chris Dodd.
GLENN: It was Chris Dodd.
PAT: Chris Dodd, uh huh.
GLENN: I am tired of the people on the left saying they didn't have all the things and what they have to understand is this is a starter home! You have to lay the foundation! We can add other wings to it! We can add additions later!
STU: It was our entire case leading up to this.
GLENN: Sure was.
PAT: Exactly. It was everything we've said it was going to be, spilling right out of Chris Dodd's mouth.
GLENN: So why don't we concentrate on those things. Because they're provable. They're actionable. And they and once these in, once these things are in, you ain't gonna have a courtroom to be able to go back on him. You give this kind of movement, if they continue this kind of movement over the next four years, I don't know what the hell you have left in the end. So why don't we go after the things that are provable, after the things that actually you need to stop right now. And if you want to argue, you want to argue, then let's argue based in fact, based on things that are provable and true. And what do you say? Do you want to argue the Constitution? Good. Let's show the number of people in congress and in the Senate that don't even read the Constitution. Can't tell you right now if healthcare is even in the Constitution. Let's talk to the scholars. Let's talk to the average Joe that understands this isn't in the Constitution. Let's argue the Constitution on the laws and the systems that they are building today. Instead of arguing the Constitution and whether or not he was born in America, why don't we argue the constitutionality of a little known thing called czars. And the power that these people have. Back in a minute.
